Terms of Service

These Terms of Service ("Terms") govern your use of glassiq.net (the "Site"), operated by HVAM Windows and Doors Corp, dba GlassIQ Windows and Doors ("GlassIQ," "we," "our," or "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Acceptance of terms

Your use of the Site constitutes acceptance of these Terms and our Privacy Policy and Cookie Policy. We may modify these Terms at any time; continued use of the Site after changes constitutes acceptance.

2. Description of services

The Site provides information about GlassIQ's impact window and door products, installation services, financing options, warranty details, and related content. Information on the Site is for general informational purposes only. Pricing examples are illustrative and not binding.

Any installation, sale, or service relationship between you and GlassIQ is governed by a separate written contract signed by both parties — not by anything published on the Site. Submitting an estimate request through the Site does not create a contractual relationship; it requests an in-person estimate at your home.

3. Estimates and quotes

Estimates issued by GlassIQ — whether discussed on the Site, by phone, or in person — are valid for the period stated on the written estimate (typically 30 days). Estimates may be revised based on actual measurements, manufacturer pricing changes, or site conditions discovered during precise measurement. No binding agreement exists until both parties sign a written contract.

4. Intellectual property

All content on the Site — including text, graphics, logos, photos, layouts, and code — is the property of GlassIQ or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws. You may view and use the Site for personal, non-commercial purposes. You may not copy, redistribute, modify, scrape, or republish Site content without our written permission.

Product names and specifications referenced on the Site are descriptive. GlassIQ is an authorized dealer for PGT, ES Windows, Mr. Glass and Eco Window Systems.

5. User conduct

You agree not to:

Use the Site for any unlawful purpose
Attempt to gain unauthorized access to any part of the Site, our servers, or related systems
Scrape, harvest, or systematically extract data from the Site (including via automated tools)
Upload viruses, malware, or harmful code
Submit false, misleading, or fraudulent information through any form
Interfere with the Site's operation or impose unreasonable load on our infrastructure

6. SMS / text messaging terms

The programme. By providing your mobile number and checking the SMS consent box on a GlassIQ form, or by texting us first, you agree to receive text messages from GlassIQ at that number. The programme is operated by GlassIQ; it is not affiliated with, endorsed by, or the responsibility of your mobile carrier. You must be 18 or older and the account holder or an authorised user of the number you provide. Consent is optional and is not a condition of any purchase.

Types of message. Conversational messages about your own request — estimate and appointment updates, installation and warranty follow-ups, and replies to questions you text us — and occasional promotional messages, namely seasonal offers, financing promotions and hurricane-season reminders.

Message frequency. Message frequency varies, depending on where your project is in the process.

Cost. GlassIQ does not charge a fee for these messages. Message and data rates may apply — standard message and data rates from your mobile carrier may apply to every message you send to or receive from us. Contact your carrier for the details of your plan.

Opting out. Reply STOP to any message at any time. We send a single confirmation and then send no further messages. STOP, END, CANCEL, UNSUBSCRIBE and QUIT are all accepted. You may also email info@glassiq.net or call 941 310 7028 to be removed.

Getting help. Reply HELP to any message for help, or contact us at info@glassiq.net or 941 310 7028, Monday to Friday, 9:00 AM – 4:00 PM Eastern.

Delivery. Delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages. We may change or discontinue the programme at any time.

Privacy. Mobile information or text messaging opt-in data and consent will not be sold or shared with third parties or affiliates for their marketing or promotional purposes. How we handle your number and consent record is described in section 4 of our Privacy Policy.

7. Third-party links and content

The Site may link to third-party websites (manufacturer documentation, social media, lenders). We do not control these sites and are not responsible for their content, accuracy, or practices. Use of third-party sites is at your own risk and subject to their terms.

8. Disclaimer of website warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. We make no warranty about the accuracy, completeness, or currency of Site content.

This disclaimer applies only to the Site. Product warranties (factory + installation) on installed windows and doors are governed by separate written warranty documents — see our Warranty page.

9. Limitation of liability

To the maximum extent permitted by Florida law, GlassIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including but not limited to lost profits, data loss, business interruption, or device damage. Our total liability for any claim arising from the Site is limited to one hundred U.S. dollars ($100).

This limitation does not apply to liability that cannot be excluded under applicable law (for example, gross negligence or willful misconduct).

10. Indemnification

You agree to defend, indemnify, and hold harmless GlassIQ, its officers, employees, and contractors from any claims, damages, liabilities, or expenses arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Governing law and jurisdiction

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Sarasota County, Florida. You consent to personal jurisdiction in those courts.

12. Dispute resolution

Before filing any legal action, you agree to first contact us in good faith at info@glassiq.net to attempt to resolve the dispute informally. If we cannot resolve it within 30 days, either party may pursue the dispute in court under the governing-law provision above.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision shall be replaced with one that most closely matches the original intent and is enforceable.

14. Entire agreement

These Terms, together with our Privacy Policy and the SMS terms in section 6 and Cookie Policy, constitute the entire agreement between you and GlassIQ regarding the Site. Separate written contracts govern any installation or service relationship.
